What is the Variation Process?
The Zoning Ordinance provides consistent development standards for all properties in the City. Occasionally, it may be difficult or challenging to meet every Zoning Ordinance requirement. In these situations, the City encourages the applicant to reconsider their development plan so that they are able to meet the Zoning Ordinance requirements. Otherwise, applicants who feel that meeting the Zoning Ordinance would be unfeasible can apply for a Zoning Ordinance variation. Zoning Variations can be granted if the Planning and Zoning Commission and the City Council agree that there is a particular hardship or practical difficulty to meeting the specific Zoning requirement. However, the applicant is responsible for proving the hardship or practical difficulty. A hardship is usually related to unique circumstances of the property, such as an odd-shaped lot, unusual topographic features, conditions on adjoining lots, or the presence of wetlands or other natural features. A desire to have a larger or more valuable house, or to avoid costs related to meeting the requirements of the Zoning Ordinance are not considered hardships.
